Terms and conditions of rental
These terms apply to every booking made directly on this site. They are reproduced in full in the confirmation e-mail.
1. Parties and purpose. Each property is let as furnished holiday accommodation, for seasonal stays, in Peyragudes (municipality of Germ, Hautes-Pyrénées, France), by its own host (the “host”), a private individual and non-professional host:
- studio 53A, Balcons du Soleil residence, rue de la Station, Peyresourde-Balestas, 65240 Germ, France, 22 m², 4 people maximum; host: Olivier Jean BANETTE, 19 chemin de la Coulée, 79260 Romans, France, SIRET 517 887 154 00055;
- T2 Serias 31, 41 m², 6 people maximum: Angélique BANETTE, appartement 31, route des Pistes, 65240 Germ, SIRET 799 426 804 00024.
The guest is the person who sends the booking request.
2. Booking. A request sent through the form does not bind the host. The host accepts or declines it by e-mail. After acceptance, the guest has 48 hours to transfer the full price of the stay and the tourist tax. The booking becomes firm when the transfer is received within that time. The host then sends the confirmation e-mail. If no transfer is received within 48 hours, the request lapses and the dates are offered again.
3. Price and payment. The price is the one shown on the site when the request is made, in euros. The tourist tax is added at the rate set by the local authority. Payment is by bank transfer only, to the account given in the acceptance e-mail.
4. Nature of the amount paid. The amount paid is payment of the price. It is not a deposit of “arrhes”: neither party has the right to withdraw attached to arrhes (Article 1590 of the French Civil Code). In case of cancellation, only the rules in Articles 6 to 9 apply.
5. Rental between private individuals. The contract is concluded between private individuals. The host does not act as a professional: the French Consumer Code, including the right of withdrawal and consumer mediation, does not apply to this contract. Prices are shown without VAT, which is not applicable.
6. Cancellation by the guest. Cancellation is made by e-mail; the date of receipt is authoritative. The applicable policy (moderate or firm) depends on the dates of the stay. It is shown before the request is sent and repeated in the acceptance e-mail.
- Moderate policy: full refund up to 5 days before arrival. After that, 1 night and 50% of the remaining nights are due. After arrival: nights stayed, plus 1 night, plus 50% of the nights not stayed.
- Firm policy: full refund up to 30 days before arrival. From 30 to 7 days, 50% of the stay is due. Less than 7 days before or after arrival, 100% is due.
- Stays of 28 nights or more: full refund up to 30 days before arrival. After that, the nights stayed and 30 nights are due.
- Common rule for stays of 27 nights or less: free cancellation within 24 hours of confirmation, if made at least 7 days before arrival.
- Tourist tax for nights not stayed is always refunded.
7. Refund. Refunds are made by bank transfer to the account used for payment, within 72 hours of cancellation, subject to interbank processing times.
8. Cancellation by the host. If the host cancels, all sums paid are refunded within the same time.
9. Force majeure. If an event of force majeure within the meaning of Article 1218 of the French Civil Code prevents the stay, the contract is terminated and the nights not stayed are refunded.
10. Stay. Arrival from 3 pm, departure by 11 am. The number of occupants may not exceed the capacity of the accommodation. No pets. Non-smoking. Bed linen and towels not provided. The guest complies with the residence rules.
11. Online deposit (Swikly). The deposit is handled online by our partner Swikly. On the arrival day, before the access codes are given, the guest registers a temporary card pre-authorisation of €300 with Swikly. Nothing is charged, except in case of damage or cleaning not done. The codes are only given after this registration. The cost of the Swikly service is paid by the owner.
12. Cleaning. End-of-stay cleaning is the guest's responsibility. A flat €150 is withheld if it is not done, or if the departure photos requested by the owners are not sent.
13. Description of the accommodation. In accordance with Article L324-2 of the French Tourism Code, the contract is in writing and states the price; the description of the accommodation is attached to the confirmation e-mail.
14. Police registration form. Guests who are not French nationals fill in a police registration form on arrival.
15. Personal data. See the privacy policy.
16. Language and governing law. These terms are written in French; this is a translation and the French version prevails. The contract is governed by French law.
